1. Service Agreement Overview

MaxxListing programs are professional real estate listing services provided by MaxxCity Realty ("Company") to property owners ("Seller") who wish to market and sell their residential property in Brevard County, Florida and surrounding areas ("Property").

By enrolling in a MaxxListing program, you agree to these Terms & Conditions and all program-specific details provided during enrollment.

2. Program Descriptions & Pricing

Essentials ($450)

One-time flat fee of $450. Includes professional MLS entry, syndication to Zillow, Realtor.com, and Homes.com, MaxxCityHomes.com feature, and 6 months of secure portal access. Marketing is limited to MLS listing and syndication only (no additional marketing services). Purchase contract review is available as an add-on service.

Seller is responsible for managing inquiries, showings, and negotiations.

Plus ($600 + $400)

$600 upfront fee + $400 due at closing. Includes everything in Essentials plus 3 Facebook posts during the first month of listing, broker coordination for listing documents and forms, unlimited purchase contract review & guidance, and closing coordination.

The $400 amount is payable at closing from seller's proceeds.

Professional (1.0%)

Commission-based pricing: 1.0% of final sale price, due at closing from seller's proceeds. Includes everything in Plus plus electronic Supra lockbox, professional photography coordination (seller covers photography costs), up to 10 social media posts per month, market comparables & pricing guidance, broker negotiation support throughout the transaction, complete transaction coordination with all parties (inspectors, banks, lenders, other agents), and priority phone support.

Example: $500,000 sale price = $5,000 due at closing.

Signature (1.5%)

Commission-based pricing: 1.5% of final sale price, due at closing from seller's proceeds. Full-service premium option including everything in Professional plus professional photography (photos, video, drone footage included), marketing strategy & game plan with up to 5 paid social media ads (60 days minimum), formal Comparative Market Analysis with detailed pricing strategy, professional staging consultation, complete transaction coordination and management with all parties, dedicated closing coordinator, and priority phone support. Optional Zillow Showcase Listing available for additional $500.

Example: $500,000 sale price = $7,500 due at closing.

3. Payment Terms

  • Essentials & Plus upfront fees are due before MLS entry
  • Payment accepted via credit card through secure Stripe checkout
  • Closing day fees and commissions are collected from closing proceeds
  • If closing does not occur, no closing fees or commissions are due
  • Refunds of upfront program fees available within 7 days of enrollment if not satisfied

4. Portal Access Duration & Availability

  • Portal access duration follows the selected program period (default 6 months)
  • Standard portal access: 6 months from MLS entry date
  • Sellers may negotiate shorter access (e.g., 3 months) or extend to 12 months via contract amendment
  • Portal token expires automatically when the program period ends
  • All seller data and uploaded photos are retained for the duration of the portal access window
  • After portal expiration, archived data remains available for 12 additional months for seller retrieval
  • Portal access is tied to program duration, not listing status (continues even if property sells)
  • Portal may be renewed for additional periods if desired
  • Seller may withdraw program at any time; pre-paid fees are non-refundable after 7 days

5. Services Provided

Professional MLS Entry: Our team will enter your property into the MLS with professional copywriting, compliance verification, and Fair Housing review.

Syndication: Your listing will be automatically syndicated to Zillow, Realtor.com, and Homes.com within 1-2 business days of MLS entry.

Portal Access: Seller receives secure, encrypted portal to manage listing, upload documents, and communicate with our team.

Document Management: Portal supports upload and storage of photos, floor plans, inspection reports, HOA documents, and other relevant files.

Broker Coordination (Plus+): Plus includes broker coordination for documents and forms, contract review, and closing coordination. Professional and Signature add broker negotiation support and dedicated closing coordinators.

Contract Review Services: Essentials includes up to 3 purchase contract reviews. Plus includes unlimited contract reviews and closing document support. Professional and Signature programs provide full contract review with negotiation assistance. Learn more about contract review services.

Electronic Lockbox: Professional and Signature programs include Supra electronic lockbox for secure agent access. Essentials and Plus sellers provide their own lockbox or arrange access with agents.

Photography Services: Signature includes professional photography, video, and drone footage. Professional and lower programs can arrange photography separately through vendors at seller's expense.

Pricing Guidance (Professional) / CMA (Signature): Professional sellers receive pricing guidance via email with 3-4 comparable sold properties. Signature sellers receive a formal Comparative Market Analysis with detailed pricing strategy recommendations.

Zillow Showcase Listing (Signature Optional): Signature program sellers may optionally add Zillow Showcase Listing for $500, payable at contract signing, for enhanced Zillow placement and visibility.

6. Seller Responsibilities

  • Provide accurate property information for MLS entry
  • Disclose all known defects and property conditions (legal requirement)
  • Maintain property in safe and showable condition
  • Arrange property access for showings as scheduled
  • Cooperate with home inspections and appraisals (buyer-requested)
  • Provide necessary documentation (HOA docs, utilities, etc.)
  • Update listing information promptly if circumstances change

7. Limitation of Liability

MaxxCity Realty provides listing services as described. We do not guarantee any specific results, number of showings, offers, or sale price. Real estate market conditions are beyond our control.

Company is not responsible for: actions of buyers or their agents, market conditions affecting your sale, property defects not disclosed, or circumstances beyond our reasonable control.

8. Confidentiality & Privacy

  • Seller information is confidential and never shared without consent
  • Portal data is encrypted and password-protected
  • Personal information is subject to MaxxCity's Privacy Policy
  • MLS information is public per Florida MLS regulations
  • Fair Housing compliance is maintained on all listings and communications

9. Termination & Cancellation

  • Refunds available within 7 days of enrollment only if property has not yet been uploaded to MLS
  • Refunds are only issued if delays are on Company side, not due to waiting for seller information
  • After 7 days or MLS upload, upfront program fees are non-refundable
  • Seller may pause or end listing at any time; existing services are not refunded
  • Company may terminate agreement if seller violates terms or fails to maintain property
  • Portal access ends 6 months after listing or upon cancellation

10. MLS & Real Estate Rules

  • All listings must comply with Florida MLS regulations
  • All listings must comply with Fair Housing Act and Florida Fair Housing requirements
  • Seller agrees to comply with all local, state, and federal real estate laws
  • Property must be legally marketable and seller must have authority to list
  • Seller warrants no liens, encumbrances, or legal issues affecting sale

11. Dispute Resolution

Any disputes arising from this agreement shall be resolved through:

  1. Direct negotiation between parties
  2. Mediation if negotiation fails
  3. Legal action in Brevard County, Florida courts if necessary

12. No Agent Relationship

MaxxListing programs do not establish an agent-principal relationship. Seller retains full control and responsibility for their property and any sales decisions. For listing coordination programs (Plus+), our team acts as a professional consultant but not as buyer's or seller's agent unless separately contracted.

13. Property Data & Marketing

  • Seller grants MaxxCity permission to use property photos and description for marketing
  • Seller's contact information will be shown to qualified buyers/agents per MLS rules
  • MLS listing data is public and cannot be kept private
  • Company may use property details in marketing materials with seller consent
  • Listing photos remain company property after listing ends

14. Changes to Terms

Company reserves the right to modify these terms with 30 days notice. Continued use of MaxxListing services constitutes acceptance of updated terms.
