This document summarizes the brokerage services selected by Seller. It supplements the Exclusive Right of Sale Listing Agreement and helps ensure both parties clearly understand the services included with the selected program.

1. Property & Parties

This agreement is attached to and made part of the Exclusive Right of Sale Listing Agreement between the Seller(s) and MaxxCity Realty LLC ("Broker"), and records the MaxxListing™ program Seller has selected, the compensation payable for that program, and any optional services ordered.

Listing Term: The standard MaxxListing™ listing term is six (6) months. Seller may elect a shorter or longer term, not to exceed twelve (12) months. Renewal, protection period, and termination rights are governed by the Exclusive Right of Sale Listing Agreement.

2. Program Selection

Each successive program includes all services provided in the previous program plus additional brokerage services. Program contents are described in the MaxxListing™ Programs brochure.

MaxxListing™ Essentials

MaxxListing™ Plus

FLAT FEE · STARTING AT $600 + $400 CLOSING COORDINATION FEE

  • • Everything in Essentials
  • • Purchase contract review and closing document review
  • • Showing coordination and contract-to-close coordination
  • • Title company and buyer broker coordination
  • • MLS compliance and closing administration
  • • Up to 10 Marketing Content Updates
  • • Seller remains responsible for negotiating purchase offers
  • • $400 closing coordination fee paid at closing

What "Starting At" Means: "Starting at" means the base price for the program. It does not include optional services, vendor-direct costs, or additional marketing selected by Seller. The amounts agreed to above are the amounts Seller agrees to pay for this listing.

5. Buyer Broker Compensation

Buyer broker compensation is negotiated separately from the listing program. Seller may choose whether to compensate a buyer's broker during contract negotiations. Broker transmits all offers received to Seller regardless of whether buyer broker compensation is requested.

Essentials and Plus: Seller is solely responsible for determining and negotiating any commission or flat fee paid to a buyer's broker. Broker transmits offers but does not present them or assist in negotiating them.

Professional and Signature: Offer presentation, review, and negotiation assistance are included. Broker handles buyer broker compensation discussions as part of negotiation support.

7. Acknowledgment of Program Scope

Seller acknowledges and agrees that:

  • • Every MaxxListing™ listing includes listing in the Space Coast Association of REALTORS® MLS, syndication to Zillow®, Realtor.com® and Homes.com®, a featured listing on MaxxCityHomes.com, professional MLS data entry, electronic document management, and MLS and Florida regulatory compliance.
  • • Under Essentials, Seller manages buyer inquiries, showings, negotiations, contracts, and closing. Broker provides up to 3 purchase contract reviews.
  • • Under Plus, Broker coordinates showing requests and scheduling. Seller remains responsible for negotiating purchase offers. An electronic lockbox is not provided under Plus.
  • • Under Professional, pricing guidance is not a formal Comparative Market Analysis or an appraisal.
  • • Under Signature, professional photography (photos, video, drone footage) is included as part of the program.
  • • Services not included in the selected program are Seller's responsibility unless separately ordered in writing.

8. Seller Responsibilities

Seller agrees to:

  • • Maintain utilities in service throughout the listing term
  • • Maintain the property in showable condition
  • • Respond promptly to Broker communications and showing requests
  • • Provide access for showings, including obtaining and maintaining Seller's own lockbox if used (Essentials and Plus)
  • • Provide accurate and complete property information
  • • Notify Broker of any material change in the property or its availability
  • • Disclose all known defects as required by Florida law

9. Broker Responsibilities

Broker agrees to:

  • • Perform the services included in the selected program
  • • Comply with Chapter 475, Florida Statutes, and FREC rules
  • • Maintain MLS accuracy and compliance for the listing
  • • Coordinate showing requests and scheduling where included in the selected program
  • • Communicate with Seller regarding activity, offers, and marketing

11. Cancellation

Seller may terminate the Listing Agreement in accordance with its terms. Broker shall retain any fees already earned for services performed. Flat listing fees are earned upon activation of the listing in the MLS. Optional marketing services already ordered are non-refundable once work has commenced. Marketing expenses advanced by Broker remain reimbursable by Seller if the listing is cancelled or expires before closing.

12. Program Changes & General Terms

12.1 Upgrades and Downgrades

Seller may change programs during the listing term only by written amendment signed by Seller and Broker. Amounts already earned for services performed remain payable.

12.2 Relationship to the Listing Agreement

This document is subject to the terms and conditions of the Exclusive Right of Sale Listing Agreement and any applicable addenda. All other terms of the Listing Agreement remain in full force.

12.3 Compliance

All marketing performed under this document complies with MLS rules, Chapter 475, Florida Statutes, FREC rules, and federal and Florida fair housing law.
