MaxxCity Realty LLC ("MaxxCity") respects the intellectual property rights of others and expects users of our services to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512), MaxxCity will respond promptly to claims of copyright infringement committed using any of our websites and online properties.

Filing a DMCA Takedown Notice
If you believe that content on any MaxxCity website or service infringes your copyright, you must send a written notice to our Designated Agent that includes all of the following elements required by 17 U.S.C. § 512(c)(3):

Identification of the copyrighted work — A description of the copyrighted work you claim has been infringed. If multiple works are covered by a single notification, provide a representative list.

Identification of the infringing material — A description of the material you claim is infringing and information reasonably sufficient to permit us to locate it (e.g., the full URL of the page where the material appears).

Your contact information — Your full name, mailing address, telephone number, and email address.

Good faith statement — A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

Accuracy statement — A statement, made under penalty of perjury, that the information in your notification is accurate, and that you are the copyright owner or are authorized to act on the copyright owner's behalf.

What Happens After We Receive Your Notice
Upon receipt of a compliant takedown notice, MaxxCity will:
- Promptly review the notice for completeness under 17 U.S.C. § 512(c)(3).
- Remove or disable access to the allegedly infringing material if the notice is facially complete.
- Notify the user who posted the material that it has been removed.
- Provide the user with a copy of the takedown notice and information about filing a counter-notification.
- Document the notice and action taken for our records.
Incomplete notices will not trigger safe harbor protections and may not receive a response until all required elements are provided.
Counter-Notification Procedure
If you believe that material you submitted was removed or disabled by mistake or misidentification, you may file a counter-notification under 17 U.S.C. § 512(g). A valid counter-notification must include:
- Your signature — Your physical or electronic signature.
- Identification of the removed material — A description of the material that was removed and the URL or location where it appeared before removal.
- Good faith statement — A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your contact information — Your name, address, and telephone number.
- Consent to jurisdiction — A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the Middle District of Florida if your address is outside the United States), and that you will accept service of process from the complainant or their agent.

What Happens After We Receive Your Counter-Notification
Upon receipt of a valid counter-notification, MaxxCity will:
- Forward a copy to the original complainant.
- Restore the removed material within 10–14 business days unless the complainant notifies us that they have filed a court action seeking an order to restrain the activity.
IDX Listing Photos and Content
Property listing photos, descriptions, and data displayed on MaxxCity websites are provided through the Space Coast MLS Internet Data Exchange (IDX) program and are owned by the respective listing brokers and their agents. MaxxCity Realty does not own or control this content.
Copyright claims related to IDX listing content should be directed to:
- The listing broker identified in the listing, or
- The Space Coast Association of REALTORS® / Brevard MLS
MaxxCity Realty will cooperate fully with any legitimate copyright inquiry related to IDX content.
Repeat Infringers
In accordance with 17 U.S.C. § 512(i), MaxxCity Realty maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers of others' intellectual property rights.
